Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Sofa.st (the “Service”), operated by Mohamed Bariki, based in Morocco. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Sofa.st lets you add documents and website content, indexes that content, and provides an embeddable chat widget that answers questions from your indexed content. The Service is provided on a subscription basis with the plans and limits described on our pricing page.

2. Accounts

You must provide accurate information when registering and keep your credentials secure. You are responsible for all activity under your account. You must be at least 16 years old, or the age of majority in your jurisdiction, to use the Service.

You are solely responsible for the content you add and for the answers your chatbot produces from it. We may suspend or terminate accounts that violate these Terms.

4. Your content

You retain all rights to the content you upload. You grant us a limited license to host, process, and transmit that content to sub-processors solely to operate the Service for you, as described in our Privacy Policy.

5. Subscriptions, billing, and taxes

Paid subscriptions are sold through Polar, which acts as our Merchant of Record. This means Polar handles the transaction and applicable sales tax or VAT, and appears on your statement as the seller. Subscriptions renew automatically each billing period until cancelled. You can cancel at any time; access continues until the end of the paid period.

6. Refunds

Our refund terms are set out in our Refund Policy, which forms part of these Terms.

7. Availability

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features with reasonable notice where practical.

8. Intellectual property

The Service, including its software, design, and trademarks, is owned by us and protected by law. These Terms grant you no rights to our intellectual property beyond the right to use the Service as permitted.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind. AI-generated answers may be inaccurate or incomplete; you are responsible for reviewing them before relying on them.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, or consequential damages, or for loss of data, revenue, or profits. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms. On termination, your right to use the Service ends and we may delete your content as described in our Privacy Policy.

12. Governing law

These Terms are governed by the laws of Morocco, without regard to conflict-of-law rules. The courts of Morocco have jurisdiction over any dispute, unless mandatory consumer-protection law grants you rights in your own jurisdiction.

13. Changes

We may update these Terms from time to time. Material changes will be reflected in the “Last updated” date above, and continued use of the Service after changes take effect constitutes acceptance.
